JUDGEMENT AGAINST THE Serene OSDE


The Court of Appeals in Commercial, Room C ordered the OSDE to inform social work properly, accurate and sufficient to its members that in the future will not apply waiting periods on benefits included in the Mandatory Health Program.

The lawsuit had been initiated by the Association of Users and Consumers Union. OSDE

used a membership form and a promotional booklet which reported that preharvest applied (waiting times) regarding subject matter contained in the Compulsory Health Plan.

Compulsory Health Plan are the basic benefits that should give the insurance plans and prepaid, without discriminating between the plans nor the date of entry into the health system.

Other features include: maternal and child plan, coverage 100% of medicines for chronic renal insufficiency, oncological diseases, tuberculosis and contraceptives. Also, 70% coverage of the reference price in chronic diseases such as cardiovascular, treatment of primary and secondary prevention, respiratory and neurological diseases, among others.

The ruling is 27/10/2006 but only became known in those days.
